Privacy Collection Notice

Victoria Police (“VP”) uses Victoria Police Entrance Examination to support its recruitment and selection processes by evaluating candidates’ capabilities across a range of general skills (“the Assessment”). The Assessment is administered by The Australian Council for Educational Research Ltd (ABN 19 004 398 145) (“ACER”).

This Privacy Collection Notice explains how ACER collects, uses, stores, and discloses your personal information in connection with your registration for and participation in the Assessment, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).

1. Collection of Personal Information

ACER may collect information or opinions which may identify or reasonably identify you (“Personal Information”). This may include your name, date of birth, contact details, and your payment details, your test answers and results, any application for special testing conditions and any communications you have with ACER concerning the Assessment.

ACER collects this Personal Information for the purpose of administering, delivering, reporting on, and quality assuring the Assessment (“the Purpose”).

It may also de-identify your Personal Information so that it is not reasonably re-identifiable to you and use that de-identified information for research purposes and disclosing to relevant research bodies.

If you do not provide the Personal Information requested, ACER may be unable to register you for, or allow you to participate in, the Assessment.

2. Collection of Sensitive Information

ACER, pursuing the Purpose, may also collect sensitive information, such as health information, where reasonably necessary to consider or implement reasonable adjustments for your Assessment session.

By ticking the box, during registration for the Assessment in the ACER portal, YOU CONSENT to ACER collecting, using, storing and disclosing your sensitive information as specified in this Privacy Statement.

If you do not wish to provide such consent, please use the contact details provided below in respect of ACER’s privacy policy or for making an enquiry.

3. Disclosure of your personal information (including sensitive information)

ACER may disclose your personal information (including sensitive information, where permitted) to the following parties where reasonably necessary for the Purpose:

  • VP and other government or statutory bodies connected with the administration or oversight of the Assessment;
  • ACER’s service providers and contractors, including providers of assessment delivery, marking, scoring, data services, and administrative support;
  • medical or other professionals, where required to assess or verify requests for reasonable adjustments; and
  • regulatory or oversight bodies, government agencies, or entities authorised by law to receive such information, including for handling complaints or investigations relating to the Assessment.


ACER will not disclose your personal information for any purpose other than those described above unless permitted or required by law.

4. Cross‑Border Disclosure

Some of your personal information may be disclosed to service providers located outside Australia, in accordance with APP 8 as follows:

  • Remote Proctoring

If you sit the Assessment by remote proctoring:

  • personal Information will be provided to ProctorU, ACER’s current provider of remote proctoring for the purpose of account generation to sit the test. ProctorU is a company based in the United States. Personal Information that is provided to ProctorU may be stored outside of Australia. You may view ProctorU’s privacy policy at https://www.meazurelearning.com/privacy-policy; and
  • in pursuit of the Purpose ACER will transfer to ProctorU some of your Personal Information such as any adjustments you have been granted to your Test sitting conditions because of you using ACER reasonable adjustments procedure. For the sake of clarity, no health information is transferred.


In compliance with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (“the Act”) ACER has taken steps, reasonable in the circumstances, to ensure ProctorU complies with those Principles.

  • Plagiarism and Integrity Checking

ACER discloses your de-identified Assessment responses to its current contracted plagiarism review contractor, Copyleaks, Inc., a Delaware company which is based in the USA. It processes Assessment test taker responses in the EU and USA to ascertain instances of plagiarism. You may view its privacy policy here: https://copyleaks.com/privacy-policy. This collection statement will be amended in the event the supplier changes.

Your rights

Under the Act you have the right to:

  1. inspect your Personal Information;
  2. request amendment of your Personal Information; and
  3. make a complaint in respect of a breach of your privacy.

Legal Notice

1. By completing and submitting the registration form for the VICTORIA POLICE ENTRANCE EXAMINATION test located at http://vpol.@acer.org You are offering to enter into a legal agreement with The Australian Council for Educational Research Ltd (ABN 19 004 398 145) (ACER).

2. The TERMS AND CONDITIONS which will apply to Your application for registration and to Your registration to participate in the VICTORIA POLICE ENTRANCE EXAMINATION test are contained in this website, including this Legal Notice. 

The Terms and Conditions cover, amongst other things, Your sitting the VICTORIA POLICE ENTRANCE EXAMINATION test, payment of the registration fee, refunds of fees, access to VICTORIA POLICE ENTRANCE EXAMINATION Preparation Materials and release of the VICTORIA POLICE ENTRANCE EXAMINATION test results.

    3. Before lodging Your Registration, You should make sure You understand fully and are familiar with the contents of this website, including this Legal Notice.

    4. You may have legal rights and guarantees under the Australian Consumer Law (being Schedule 2 to the Competition and Consumer Act 2010 (Cth), as amended from time to time). If the publication of this website or Your registration for or participation in the VICTORIA POLICE ENTRANCE EXAMINATION test involves a supply of goods or services to a consumer within the meaning given in the Australian Consumer Law, nothing contained in this website excludes, restricts or modifies the application of any consumer guarantee provided in the Australian Consumer Law, the exercise of any right or remedy in respect of, or the imposition of any liability for the failure to comply with any relevant guarantee.

    5. Subject to point 4:

    a. to the maximum extent permissible by law (and for the avoidance of doubt, subject to any guarantees, rights, remedies or obligations which cannot be excluded, restricted or modified under the Australian Consumer Law), ACER expressly, irrevocably and totally disclaims any liability whatsoever for any loss or damage whatsoever and howsoever arising in connection with or resulting from: Your participation (actual, potential, contemplated or cancelled for any reason whatsoever) in the VICTORIA POLICE ENTRANCE EXAM; and Your test results, including, but not limited to, any representations made by ACER or its personnel (including agents, subcontractors and consultants) in respect of VICTORIA POLICE ENTRANCE EXAMINATION and the accuracy of any information contained in this website.

    b. to the fullest extent permitted at law, You acknowledge and accept that the entire risk of Your participation in VICTORIA POLICE ENTRANCE EXAMINATION is assumed by You and that ACER will have no liability whatsoever to You for any loss, harm, damage, cost or expense (including legal fees) or any direct, special, indirect, incidental, punitive or consequential loss or damage (including, without limitation, economic loss, loss of contract, profit, revenue, income, opportunity, goodwill, information, anticipated savings, business relationships, production or data) whatsoever and howsoever arising.

    c. You acknowledge and accept that, to the fullest extent permitted at law, ACER gives NO WARRANTY or guarantee and makes no representation whatsoever that: registering for or sitting the VICTORIA POLICE ENTRANCE EXAMINATION test will guarantee You or secure for You a placement with the Victoria Police; or that You will be provided with Your VICTORIA POLICE ENTRANCE EXAMINATION results (other than in strict accord with this Agreement).

    6. ACER has made every effort to ensure the accuracy of the information provided in this website. , ACER reserves the right to alter or amend any detail contained in the website in its absolute and unqualified discretion.       By completing and submitting the VICTORIA POLICE ENTRANCE EXAMINATION registration form, You:

      a. confirm that You have read in its entirety and accept the contents of this website, including the Legal Notice;

      b. confirm Your agreement with the terms and conditions contained in this website;

      c. acknowledge that You have been entitled to obtain legal advice concerning any matter covered in this website, whether or not You have in fact sought any legal advice;

      d. acknowledge and accept that this website contains the entire agreement between You and ACER concerning Your participation in the VICTORIA POLICE ENTRANCE EXAMINATION and that no matter, information or representation not expressly contained in this website has induced You or had any bearing on You to seek registration for the VICTORIA POLICE ENTRANCE EXAM;

      e. accept and unconditionally undertake to strictly comply with the terms and conditions contained in this website;

      f. acknowledge and accept that Your agreement with ACER will be governed by the laws of the State of Victoria, Australia; and

      g. submit to the jurisdiction of the Courts chosen by ACER and any of the Courts of Appeal there from to determine any dispute (whether as to the interpretation of Your agreement with ACER, or any matter concerning performance or compliance of the agreement or otherwise) or to determine any claims brought or made against You by ACER or its authorised nominee.
